Pinellas County acquired a borrow pit adjacent to our client's Odessa property. They attempted to turn it into an attractive lake where residents could enjoy lakefront property and even build docks.

The lake overflowed, flooding our client's stable, yard and driveway for much of the year, every year. It got so bad she had to drive an ATV or kayak to get from her parking spot to her driveway and home.

Our client used to board horses at her barns. Her two barns flooded and remained flooded even three weeks after a rain. The flooding made it impossible to board horses.

Flooding took away land on which the horses grazed. Flood waters rendered the barn and pasture land unusable. The land became contaminated and eroded. As it turned out, their property became the lake, especially during the rainy season.

A claim of unlawful taking of private property by flooding against Pinellas County was filed. We aggressively pursued and fought for our client culminating in a mediation.

A settlement was reached in favor of our client.
